GENERAL TERMS OF SALE
1 General Provisions
1-1 Acceptance of the general conditions
The customer declares to have read the general terms and conditions of sale and to have accepted them without reservation before placing an order.
The customer will not be able to place an order unless he/she checks the box provided for this purpose.
E.ZICOM reserves the right to adapt or modify at any time the present general conditions of sale. In this case, only the general conditions of sale in force at the time of the order will be applicable.
The customer has the possibility to print the present general sales conditions.
The present general conditions of sale establish the contractual conditions exclusively applicable to any purchase made on the E.ZICOM website by any buyer having the quality of consumer.
Login credentials are generated at the time of the first order to allow the customer to confirm and fill in the information necessary to process his order, then to access his personal space on the site. These identifiers are personal and confidential. They must not be communicated to any third party.
This step assumes that the customer who registers enjoys the legal capacity necessary to order or that he/she holds a mandate if he/she acts on behalf of a legal entity.
2 Pre-contractual information
|Article L. 111-1, 5º of the Consumer Code
“Information relating to legal guarantees, the existence and the terms of implementation of these guarantees”
Article R. 111-1, 3º of the Consumer Code
For the application of 5º of Article L. 111-1, the trader shall provide the consumer with the following information:
“If applicable, the existence and the terms of exercise of the legal guarantee of conformity mentioned in articles L. 217-4 to L. 217-13 of this code and that of defects in the thing sold under the conditions provided for in articles 1641 to 1648 and 2232 of the civil code as well as, where applicable, the commercial guarantee and after-sales service within the meaning of articles L. 217-15 and L. 217-17 of this code respectively.”
“The general conditions of sale applicable to consumer contracts shall mention:
Article L. 211-2 of the Consumer Code
1º According to the terms set by order of the Minister responsible for the economy, the existence, the conditions of implementation and the content of the legal guarantee of compliance and the guarantee relating to defects in the thing sold, due by the seller ;
2º Where applicable, the existence of a commercial guarantee and service.”
Order of December 18, 2014 on the information contained in the general conditions of sale regarding legal warranty
“Art. 1er – Pursuant to Article L. 133-3 of the Consumer Code, the general terms and conditions of sale of consumer contracts must include the name and address of the seller guaranteeing the conformity of the goods to the contract, allowing the consumer to make a claim under the legal guarantee of conformity provided for in Articles L. 211-4 et seq. of the Consumer Code or the guarantee of defects in the thing sold as defined in Articles 1641 et seq. of the Civil Code.
Art. 2 – The general conditions of sale of consumer contracts mention that the seller is bound by the defects of conformity of the good to the contract under the conditions of article L. 211-4 and following of the consumer code and the hidden defects of the thing sold under the conditions provided for in articles 1641 and following of the civil code.
Art. 3 – The general conditions of sale of consumer contracts shall include in a box the statements that, when acting in legal guarantee of conformity, the consumer:
– has a period of two years from the delivery of the goods to act;
– may choose between repair or replacement of the good, subject to the cost conditions provided by Article L. 211-9 of the Consumer Code ;
– is exempt from proving the existence of the lack of conformity of the good during the six months following the delivery of the good. This period is increased to twenty-four months from March 18, 2016, except for second-hand goods. This same box reminds us that the legal guarantee of conformity applies independently of any commercial guarantee that may have been granted. It recalls that the consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he may choose between the resolution of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
Art. 4 – This order shall come into force on 1er March 2015.
Art. 5. – The Director General of Competition, Consumer Affairs and Fraud Control is responsible for the execution of this order, which will be published in the Journal officiel de la République française.

To place an order, the customer makes his or her choice on the www.eziclean.com website and subsequently fills out the online order form under his or her sole responsibility by specifying all the information requested.
The automatic recording systems are considered as proof of the nature, content and date of the order.
In order to place an order, customers will be able to select one or more items and add them to their basket. When their order is complete, they will be able to access their basket by clicking on the button provided for this purpose.
The availability of products is indicated on the site, in the description of each item.
By consulting their basket, customers will be able to check the number and nature of the items they have chosen and will be able to check their unit price as well as the total price of the order. They will be able to remove one or more items from their basket. If they are satisfied with their order and wish to validate it, customers will be able to click on the validate button, they will then access a form in which they can either enter their connection identifiers if they already have them, or register on the site by completing the form presented to them, with the information concerning them.
Once they are connected or after having perfectly completed the form, customers will be invited to check or modify their delivery and billing details and will then be informed that their purchase will only be validated after payment of the chosen items. They will then be invited to make their payment by being redirected to the secure payment interface.
Once the payment is effectively received by E.ZICOM, the latter undertakes to immediately send the customer an e-mail summarizing the order and confirming its processing, including all information relating to the order, the products ordered and their delivery. The sale will then be deemed concluded.
E.ZICOM reserves the right to cancel any order from a Customer with whom there is a dispute over payment of a previous order.
The information stated by the purchaser, at the time of the order taking engages this one. In case of error of seizure, E.ZICOM could not be held responsible for the consequences in term of delay or impossibility of delivery. All the expenses related to the forwarding of the products due to an error of seizure of the customer will be the exclusive responsibility of the customer.
Orders can only be placed via the www.eziclean.com website or other partner websites.
All orders placed on the www.eziclean.com website are for the personal use of the customers or the recipients of the products. Any partial or total resale of the products is prohibited.
Promotional codes cannot be combined with current offers.
Any commercial offers are only applicable if they are expressly specified on the site at the time of the order and if the conditions are respected. They are not cumulative between them.
3-2 Order Modification
Modification of the order by the buyer:
Since orders are final and irrevocable, any request for modification made by the buyer is subject to acceptance by the seller.
Modification of the order by the seller:
The seller is obliged to deliver a product in conformity with the one ordered.
In case of unavailability of the ordered product, the seller proposes to the consumer, who must give his agreement, the supply of an equivalent product likely to replace the ordered product.
In case of disagreement of the customer, the unavailability of the ordered product involves the cancellation of the order and the refunding of the consumer.
The seller may only make changes to the ordered product that are related to technical developments under the conditions provided for in Article R. 212-4, para. 4 of the Consumer Code with the express consent of the customer.
3-3 Validity of the order
The seller reserves the right to refuse any order for legitimate reasons and more particularly in the case where the quantities ordered are abnormally high compared to the quantities usually ordered by buyers in their capacity as consumers or in the case of a Customer with whom there is a dispute relating to the payment of a previous order.
In case of error of seizure, E.ZICOM could not be held responsible for the consequences in term of delay or impossibility of delivery. All the expenses related to the forwarding of the products due to an error of seizure of the customer will be with the exclusive load of the customer.
3-4 Retraction period
In accordance with Articles L.221-18 and following of the Commercial Code, the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to give reasons or pay penalties, except, where appropriate, the cost of return.
The fourteen-day period runs from receipt of the goods by the consumer or a third party, other than the carrier, designated by him, for contracts for the sale of goods. For off-premises contracts, the consumer can exercise his right of withdrawal from the conclusion of the contract.
In the case of an order for several goods delivered separately or in the case of an order for a good composed of multiple lots or parts whose delivery is staggered over a defined period, the period runs from the receipt of the last good or lot or part.
For contracts providing for regular delivery of goods over a defined period of time, the period shall begin upon receipt of the first good.
To exercise the right of withdrawal, the Customer must either:

The company E.ZICOM will then send all the terms of return by email within 48h to 72h.
If the responsibility of the customer can be engaged in case of depreciation of the goods resulting from handling other than those necessary to establish the nature, characteristics and proper functioning of these goods, E.ZICOM could then seize the competent courts to invalidate this right of withdrawal. The customer shall handle and inspect the item during the withdrawal period with all due care.
In case of exercising the right of withdrawal within the above-mentioned period, only the price of the product(s) purchased and the shipping costs will be refunded, the return costs remaining at the customer’s expense. The returns of products are to be made in their original condition and complete (packaging, accessories, instructions …) so that they can be remarketed in new condition; they must be accompanied by a copy of the proof of purchase.
Refund procedure: No later than 14 days from the date that E.ZICOM collects the goods subject to refund or within 14 days from the date that customer provides proof of shipment of the goods (whichever is earlier), E.ZICOM shall refund customer using the same payment method that customer used for the original transaction unless customer expressly agrees to the use of another payment method and provided that the refund does not incur any cost to customer.
3-5 Termination or cancellation of the order
- The order may be terminated by the buyer by registered letter with acknowledgement of receipt sent to E.ZICOM at the following address 46-48 RUE GAY LUSSAC 94430 CHENNEVIERES SUR MARNE in the event:
– delivery of a product that does not conform to the declared characteristics of the product;
– of delivery exceeding the deadline set out in the order form or, in the absence of such a date, within thirty days of the conclusion of the contract, after the seller has been enjoined, under the same terms and conditions and to no avail, to make the delivery within a reasonable additional period.
– price increase that is not justified by a technical modification of the product imposed by public authorities.
- The order may be terminated by the seller in case:
– of refusal by the buyer to take delivery;
– of non-payment of the price.
4-1 Product characteristics
The customer can, prior to his order, take note of the essential characteristics of the products he wishes to order by consulting the pre-contractual information communicated to him by the seller on the E.ZICOM website.
4-2 Availability of stocks
Products are offered and delivered within the limits of available stocks.
In case of unavailability of the ordered product, the seller immediately informs the buyer and can offer him a product of an equivalent quality and price or, failing that, a voucher for the amount of the order usable for any future order.
In case of disagreement of the buyer, the salesman proceeds to the refunding of the paid sums within 30 days.
Apart from the refund of the price of the unavailable product, the seller is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to him.
5-1 Selling Price
The prices of the products offered for sale by the company E.ZICOM are indicated in Euros on the site all taxes included excluding participation in processing and shipping costs and are valid as long as they are present on the screen.
All the orders are payable in Euros.
The company E.ZICOM reserves the right to modify its prices at any time but the products will be invoiced on the basis of the tariffs in force at the time of the recording of the orders subject to availability at this date.
The products remain the property of the company E.ZICOM until the complete collection of the price by the company E.ZICOM.
The possible commercial offers apply only under reserve that they are expressly specified on the site at the date of the order and under reserve to respect the conditions of it. They are not cumulative between them.
5-2 Delivery and product pickup costs
The additional costs of transport, delivery or postage (to which must be added any other costs borne by the seller), of which the customer is aware before ordering, appear according to the choice made by the customer, in the order summary before payment as additional costs added to the price of the product or products ordered.
For all orders placed and worth less than €50.00 including VAT, shipping costs to France (and Corsica) are :
- Delivery CHRONOPOST in Relay Point: Delivery the next day before 14h in France to more than 5,000 Pickup relays. The Relay point is to be chosen when you order: 9,99€ TTC
- Predict home delivery by appointment: 24-72h home delivery in the time slot that suits you best (among choices offered by DPD): 9,99€ TTC
- Delivery by CHRONOPOST “CHRONO 13”: Next day delivery before 1pm from Monday to Saturday: 14,99€ TTC
- For any order placed and of a value greater than or equal to 50.00€ TTC, shipping costs to France (and Corsica) are offered in DPD PREDICT. Other transport solutions remain payable in accordance with the rates previously indicated.
For any order placed to European countries and others shipping costs are managed by our Carrier DPD. A simulation is offered before any order is placed.
The customer should always check his package upon arrival. It is strongly advised to issue a Reserve upon receipt of the package with the carrier.
No delivery can be made via a P.O. Box, P.O. Box, Cash on Delivery or Poste Restante.
For reasons of availability, an order can be delivered in several times to the customer. The customer pays only for one delivery. If the customer wishes 2 places of delivery, he places 2 orders, with the related delivery charges.
In the case of a technical product, the customer will particularly take care to check the good functioning of the delivered device, to read the user’s guide which is provided to him. In case of apparent defects, the buyer has the right of return under the conditions provided in this document.
5-3 Price modification
The seller reserves the right to modify its prices at any time, in particular in the event of an increase in costs, it being understood that, in the event of a price increase subsequent to the order, only the price set on the day of this order will be applicable to the customer.
In the event of a price increase due to the application of the price list in effect on the day of delivery, the buyer has the right to cancel the order.
6 Payment of price
The price charged to the customer is the price indicated on the order confirmation sent by E.ZICOM.
The price of the products is payable, in Euros, in cash, the day of the effective order.
6-1 Methods of payment
The payment of purchases can be made by credit cards, through secure online payment solutions MERCANET, PayPal or STRIPE .
The order validated by the customer will be considered effective only when the concerned banking payment centers have given their agreement. In case of refusal of the said centers, the order will be automatically cancelled. In addition, E.ZICOM reserves the right to refuse any order from a customer with whom there is a dispute.
The bank BNP allows to pay on line via its banking server in a protected environment.
The N° of bank card of the customers is thus directed towards the servers of the bank. The payment of customers is made directly to a bank in a totally secure and encrypted environment, without passing through the server of the store, guarantee all the more important that the numbers are known only to the banking partner of E.ZICOM (BNP – MERCANET).
6-2 Clause of property reserve
The seller remains the owner of the products sold until full payment of the price and the buyer undertakes, as long as ownership is not transferred to him, to take all precautions useful for the proper preservation of the products.
Delivery means the transfer to the consumer of physical possession or control of the goods.
7-2 Delivery Time
The products shall be delivered on the date or within the period indicated by E.ZICOM at the time of the order.
In the absence of any indication as to the date of delivery or performance of the services, the seller undertakes in any event to deliver the products or provide the services within 7 working days of the order.
7-3 Delayed Delivery
When the ordered product is not delivered or the service is not provided on the date or at the expiration of the period mentioned on the day of the order validated by the payment, the consumer may, after having unsuccessfully enjoined the seller to perform its delivery obligation within a reasonable additional period, cancel the contract by registered letter with request for acknowledgement of receipt or by a writing on another durable medium.
7-4 Place of Delivery
Products are delivered to the address indicated by the customer.
7-5 Delivery terms
Delivery shall be made by handing over the product directly to the buyer or, failing that, by the seller sending a notice of availability to the buyer.
Within fifteen days of the notice of availability, the buyer must withdraw the ordered product.
In the absence of withdrawal within the time indicated, the salesman can, after a formal demand of the purchaser, remained without effect, to proceed to the withdrawal, to cancel by rights the order.
When the product is delivered to the address indicated on the order form by a carrier, it is the responsibility of the buyer to verify in the presence of the deliveryman the condition of the product delivered and, in case of damage or missing items, to issue reservations on the delivery note or on the transport receipt, and possibly to refuse the product and notify the seller.
7-6 Delivery and Transfer of Risk
Risk of loss or damage to the goods shall pass to the customer at the time the customer or a third party designated by the customer other than E.ZICOM’s designated carrier takes physical possession of the goods.
7-7 Spare Parts
E.ZICOM guarantees the consumer the storage and availability of spare parts for the goods sold for a minimum period of 3 years following the purchase of the product.
Articles L. 111-4 and D. 111-4 of the Consumer Code:
“The seller must confirm at the time of purchase of the good on the order form or the general conditions of sale or on any other durable medium to the consumer the information that he has already given under the pre-contractual information and which has been delivered to him by the manufacturer or importer of movable goods concerning the period during which or the date until which spare parts essential to the use of a good are available.”
Seller agrees to provide a good that complies with applicable legal requirements and contractual requirements.
9 Legal warranty of conformity
9-1 Consumer information
|Article L. 111-1, 4º of the Consumer Code:
“Before the consumer is bound by a contract for the sale of goods or provision of services, the trader shall communicate to the consumer, in a legible and comprehensible manner, the following information :
4º Information relating to the existence and implementation of guarantees and other contractual conditions. The list and precise content of this information shall be set by decree in the Council of State.”
Article R. 111-1, c) of the Consumer Code:
“For the application of 4º of Article L. 111-1, the professional communicates to the consumer the following information:
c) If applicable, the existence and terms of exercise of the legal guarantee of conformity mentioned in Articles L. 217-4 to L 217-14 of this code and that of defects in the thing sold under the conditions provided for in Articles 1641 to 1648 and 2232 of the Civil Code as well as, where appropriate, the commercial guarantee and after-sales service within the meaning of Articles L. 217-15 and L. 217-17 of this code, respectively.”
Article L. 211-2 of the Consumer Code:
“The general conditions of sale applicable to consumer contracts mention :
1º According to the terms set by order of the Minister in charge of the economy, the existence, the conditions of implementation and the content of the legal guarantee of conformity and the guarantee relating to defects in the thing sold, due by the seller ;
2º Where applicable, the existence of a commercial guarantee and after-sales service.”
Independently of the commercial guarantee that may be granted, the seller is liable for defects in conformity of the property subject to the contract under the conditions of Article L. 217-4 et seq. of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in Articles 1641 et seq. of the Civil Code.
In accordance with the law, E.ZICOM assumes two guarantees: of conformity and relative to hidden defects of products. E.ZICOM refunds the buyer or exchanges the products apparently defective or not corresponding to the order made.
The products of the company E.ZICOM give right to the legal guarantee in force of 24 months.
In accordance with the law, the company E.ZICOM assumes a legal guarantee of conformity. It lasts for 24 months from the delivery of the goods.
The legal guarantee of conformity can be acted upon by the consumer if:
- The good is unfit for the use ordinarily expected of similar goods;
- It does not correspond to the description given by the seller;
- It does not have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling;
- It does not have the characteristics defined by mutual agreement between the parties;
- Is unsuitable for any special purpose sought by the buyer, brought to the seller’s attention and accepted by the seller.
It is recalled that the legal guarantee of conformity does not apply if:
- The customer had knowledge of the defect at the time of purchase;
- The customer could not have been unaware of the defect at the time of purchase:
- The defect resulted from materials that the customer supplied or added.
The following are excluded from the warranty: damage resulting from failure to follow the instructions for use of the products, normal wear and tear of the products, poor maintenance, accidental damage or damage resulting from abnormal use of the products, an error by the customer, his client or users of the equipment or a failure on their part to perform basic operations of use; those resulting from the use on the equipment or installation of products other than those recommended by the manufacturer; those originating from a cause external to the equipment or installation or their accessories (in particular, blows, shocks, breakage, clearing, oxidation, falls, fires, scratches, etc.); those corresponding to progressive wear and tear of the equipment or installation. ); those corresponding to normal progressive wear and tear of the equipment or its accessories implying their replacement; those at the origin of which or for the repair of which intervened third parties not approved either by E.ZICOM or by the manufacturer during the warranty period.
If the customer implement the legal warranty of non-conformity, you should contact the company (a response as soon as possible will be provided by E.ZICOM).

The E.ZICOM company then offers you a free service for the return of your product :

* Processing within 21 working days maximum (within 5 days on average)
For any request for after-sales service return, the customers coming from the DOM-TOM will see their forwarding costs, by the Colissimo Service (only), refunded by E.ZICOM.
In the event of breakdown not covered by the guarantee, or sending of a file of assumption of responsibility SAV with missing administrative parts, an estimate of an amount of 99,00€ including all taxes will be sent to the customer. If it should be refused, the device will be returned after reception of the copy of the refused estimate signed and of a payment of 32,00€ TTC for administration, storage and product return expenses.
The seller reminds that:
- the customer has a period of two years from the delivery of the goods to act with the seller,
- that he can choose between replacement and repair of the good. The customer may also be reimbursed in full (by returning the product) or partially (by keeping the product) if these two options are impossible, cannot be implemented within one month of the customer’s complaint or create a major inconvenience.
- that he is exempted from proving the existence of the lack of conformity of the good for two years for new goods and six months for used goods ,
- that the customer may also assert the guarantee against latent defects of the thing sold within the meaning of Article 1640 of the Civil Code and in this case he can choose between the resolution of the sale or a reduction of the sale price.
9-2 Implementation of the guarantee of conformity
|Article L. 217-4 of the Consumer Code:
“The seller is required to deliver a good in conformity with the contract and is responsible for defects in conformity existing at the time of delivery.
He is also responsible for defects in conformity resulting from the packaging, assembly instructions or installation when it was put at his expense by the contract or was carried out under his responsibility.”
Article L. 217-5 of the Consumer Code:
“The good is in conformity with the contract :
1º if it is fit for the purpose ordinarily expected of similar property and, where applicable
– if it corresponds to the description given by the seller and possess the qualities that the latter has presented to the buyer in the form of a sample or model ;
– if it has the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling ;
2º Or if it has the characteristics defined by mutual agreement by the parties or be fit for any special purpose sought by the buyer, brought to the attention of the seller and that the latter has accepted.”

10 Warranty of Hidden Defects
|Article 1641 of the civil code:
“The seller is bound by the guarantee because of hidden defects of the thing sold which make it unfit for the purpose for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would have given only a lesser price, if he had known them.”
Article 1648 of the Civil Code:
“The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect”.
The customer may decide to implement the warranty against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code.
In this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
11 Commercial Warranty
11-1 Consumer information
Independently of the commercial guarantee, the seller remains bound by the legal guarantee of conformity mentioned in articles L. 217-4 to L. 217-12 of this code and that relating to defects in the thing sold, under the conditions provided for in articles 1641 to 1648 and 2232 of the civil code .
11-2 Definition of the commercial warranty
E.ZICOM offers its customers a 1-year commercial warranty that starts the day after the last day of the 2-year legal warranty. In order to benefit from this 1-year commercial warranty extension, you should register your product on the website www.eziclean.com in the “PRODUCT REGISTRATION” section and accept the terms of the warranty extension contract.

|Article L. 217-15 of the Consumer Code:
“The commercial guarantee means any contractual commitment by a professional to the consumer for the reimbursement of the purchase price, replacement or repair of the good, in addition to his legal obligations to ensure the conformity of the good.”
11-3 Warranty Agreement
|Article L. 217-15 of the Consumer Code:
“The commercial guarantee is the subject of a written contract, a copy of which is given to the buyer.
The contract specifies the content of the guarantee, the terms of its implementation, its price, its duration, its territorial scope and the name and address of the guarantor and reproduces Article L. 211-16.”
11-4 Purpose and conditions of the guarantee
The seller undertakes to repair or replace under specified conditions the product sold if a defect appears within 1 year after the end of the legal warranty period.
11-5 Product downtime due to repair
In accordance with Article L. 217-16 of the Consumer Code, any period of immobilization of at least seven days due to the repair of the product covered by the warranty is added to the duration of the warranty initially granted.
12- Breakdown on unpacking
Comes within the scope of this procedure a failure occurred and reported to the company E.ZICOM or its reseller partner within 10 days after the date of billing of the product and / or receipt.
In order to meet the requirements of the customers, E.ZICOM will ensure the shipment of a new replacement product subject to compliance with the conditions set out in the “Support Form”.
