TERMS AND CONDITIONS

1 General provisions

1-1 Acceptance of the general terms and conditions

The customer declares to have read the general terms and conditions of sale and to have accepted them without reservations before placing an order.

The customer will not be able to place an order if they do not tick the box provided for this purpose.

E.ZICOM reserves the right to adapt or change these general terms and conditions at any time. In this case, only the general terms and conditions of sale in force at the time the order is taken will then be applicable.

The customer is able to print the current general terms and conditions of sale.

1-2 Purpose

These general terms and conditions of sale set out the contractual conditions exclusively applicable to any purchase made on the E.ZICOM website by any buyer with the status of consumer.

1-3 Identifiers

Login credentials are generated at the time of the first order to allow the customer to confirm and fill in the information required to process the order, and then to access their personal area on the site. These credentials are personal and confidential. They must not be disclosed to any third party.

This step assumes that a registering customer has the legal capacity to order or that they hold a mandate if acting on behalf of a legal entity.

2 Pre-contractual information

Article L. 111-1(5) of the Consumer Code

“Information relating to the legal guarantees, the existence and the methods of implementation of these guarantees”.

Article R. 111-1(3) of the Consumer Code

For the purposes of Article L. 111-1(5), the trader shall provide the consumer with the following information:

“If applicable, the existence and the terms of exercise of the legal guarantee of conformity mentioned in Articles L. 217-4 to L. 217-13 of the present code and that of the defects of the goods sold under the conditions provided for in Articles 1641 to 1648 and 2232 of the Civil Code as well as, where applicable, the commercial guarantee and after-sales service within the meaning of Articles L. 217-15 and L. 217-17 of the present code respectively”.

“The general terms and conditions of sale applicable to consumer contracts shall mention:

Article L. 211-2 of the Consumer Code

According to the terms and conditions set by order of the Minister for the economy, the existence, the conditions of implementation and the content of the legal guarantee of conformity and the guarantee relating to defects of the sold item, due by the seller;

Where applicable, the existence of a commercial warranty and service.”

Order of 18 December 2014 relating to the information contained in the general terms and conditions of sale regarding the legal warranty

« Art. 1st – Pursuant to Article L. 133-3 of the Consumer Code, the general terms and conditions of sale of consumer contracts must include the name and address of the seller guaranteeing the conformity of the goods to the contract, enabling the consumer to make a claim under the legal guarantee of conformity provided for in Articles L. 211-4 et seq. of the Consumer Code or the guarantee of the defects of the thing sold within the meaning of Articles 1641 et seq. of the Civil Code.

Art. 2. – The general terms and conditions of sale of consumer contracts mention that the seller is liable for defects in the conformity of the goods to the contract under the conditions of article L. 211-4 and following of the Consumer Code and for hidden defects in the goods sold under the conditions provided for in articles 1641 and following of the Civil Code.

Art. 3. – The general terms and conditions of sale of consumer contracts shall include in a box a statement to the effect that, when acting as a legal guarantee of conformity, the consumer:

has a period of two years from the date of delivery of the property to act;

may choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 211-9 of the French Consumer Code ;

shall be exempt from furnishing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This period shall be extended to 24 months from 18 March 2016, except for second-hand goods. The same box also recalls that the legal guarantee of conformity applies independently of any commercial guarantee that may have been granted. It recalls that the consumer can decide to implement the guarantee against hidden defects of the goods sold within the meaning of Article 1641 of the Civil Code and that in this case, they can choose between the cancellation of the sale or a reduction of the selling price in accordance with Article 1644 of the Civil Code.

Art. 4. – This Order shall enter into force on 1st March 2015.

Art. 5. – The Director-General for Competition, Consumer Affairs and Fraud Prevention shall be responsible for the implementation of this Order, which shall be published in the Official Journal of the French Republic.

3 Orders

3-1 Terms and conditions

To place an order, the customer makes their choice on the website www.eziclean.com and then fills in the online order form under their sole responsibility, specifying all the information requested.
Automatic recording systems are considered as proof of the nature, content and date of the order.

In order to place an order, customers will be able to select one or more items and add them to their basket. When their order is complete, they will be able to access their basket by clicking on the button provided for this purpose.

The availability of the products is indicated on the site, in the descriptive sheet of each article.

By consulting their basket, customers will be able to check the number and nature of the items they have chosen and will be able to check their unit price as well as the overall price of the order. They will be able to remove one or more items from their basket. If they are satisfied with their order and wish to confirm it, customers can click on the confirm button. They will then access a form in which they can either enter their login details, if they already have them, or register on the site by completing the form presented to them with the information requested about them.

As soon as they are logged in or after having correctly completed the form, customers will be invited to check or modify their delivery and invoicing details and will then be informed that their purchase will only be confirmed after payment of the chosen items. They will then be invited to make payment by being redirected to the secure payment interface.

Once the payment is received by E.ZICOM, the latter undertakes to send the customer an instant email summarising the order and confirming its processing, including all information relating to the order, the products ordered and their delivery. The sale will then be deemed as confirmed.

E.ZICOM reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order.

The information stated by the buyer, when taking an order, is binding on the buyer. E.ZICOM shall not be liable for any consequences in the event of a typing error leading to a delay or impossibility of delivery. All costs related to the reshipment of products due to a typing error by the customer will be the sole responsibility of the customer.

Orders can only be placed via the website www.eziclean.com or other partner websites.

All orders placed on the www.eziclean.com website are for the personal use of the customers or the recipients of the products. Any partial or total resale of the products is prohibited.

Promotional codes cannot be combined with current offers.

Any commercial offers are only applicable provided that they are expressly specified on the site at the date of the order and subject to compliance with the terms and conditions. They are not cumulative.

3-2 Changing an order

Modification of the order by the buyer:

As orders are final and irrevocable, any request for modification made by the buyer is subject to acceptance by the seller.

Modification of the order by the seller:

The seller undertakes to deliver a product that conforms to that ordered.

In case of unavailability of the product ordered, the seller offers the consumer, who must give their consent, the supply of an equivalent product that can replace the product ordered.

In case of disagreement by the customer, the unavailability of the ordered product leads to the cancellation of the order and a refund given to the consumer.

The seller may not make any modifications to the product ordered that are related to technical developments under the conditions provided for in Article R. 212-4, paragraph. 4 of the Consumer Code except with the express agreement of the customer.

3-3 Validity of the order

The seller reserves the right to refuse any order for legitimate reasons, and more particularly in the case where the quantities ordered are abnormally high compared to the quantities usually ordered by buyers as consumers or in the case of a Customer with whom there is a dispute over the payment of a previous order.

E.ZICOM shall not be liable for any consequences in the event of a typing error leading to a delay or impossibility of delivery. All costs related to the reshipment of products due to a typing error by the customer will be the sole responsibility of the customer.

3-4 Withdrawal period

In accordance with article L 121-20 of the Consumer Code,“The consumer has a period of fourteen clear days to exercise their right of withdrawal without having to justify their reasons or pay any penalties, with the exception, where appropriate, of the cost of returning the goods”. The time limit mentioned in the preceding paragraph shall run from receipt in the case of goods and from acceptance of the offer in the case of services”. The right of withdrawal can be exercised by contacting the company in the following manner:

E.ZICOM will then send all the return instructions by email within 48 to 72 hours.

If the customer is responsible for the depreciation of the goods resulting from handling other than that necessary to establish the nature, the characteristics and the correct functioning of the goods, then E.ZICOM may take action through the relevant courts to invalidate this right of withdrawal. The Customer must handle and inspect the item during the withdrawal period with all due care.

In case of exercise of the right of withdrawal within the above-mentioned period, only the price of the product(s) purchased and the shipping costs will be refunded, the return costs remaining at the customer’s expense. Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) so that they can be resold as new; they must be accompanied by a copy of the proof of purchase.

Reimbursement procedure: No later than 14 days from the date on which E.ZICOM collects the goods for refund, or within 14 days from the date on which the customer has provided proof of dispatch of the goods (whichever is earlier), E.ZICOM will refund the customer using the same means of payment as that used by the customer for the original transaction, unless the customer has expressly agreed to use another means of payment and provided that the refund does not incur any costs to the customer.

3-5 Termination or cancellation of the order
  • The order can be cancelled by the buyer by registered letter with acknowledgement of receipt sent to E.ZICOM at the following address 46-48 RUE GAY LUSSAC, 94430 CHENNEVIERES SUR MARNE, in case of:

– delivery of a product not conforming to the declared characteristics of the product;

– delivery exceeding the deadline set in the purchase order or, in the absence of such a date, within thirty days of the contract being entered into after the seller has been instructed, in the same manner and without result, to make delivery within a reasonable additional period.

– price increase not justified by a technical modification of the product imposed by the government.

  • The order can be cancelled by the seller in the case of:

the buyer’s refusal to take delivery;

non-payment of the purchase price.

4 Products

4-1 Product characteristics

Prior to their order, the customer can take note of the essential characteristics of the products they wish to order by consulting the pre-contractual information made available to them from the seller on the E.ZICOM website.

4-2 Stock availability

Products are offered and delivered within the limits of available stocks.

In the event of unavailability of the product ordered, the seller shall immediately inform the buyer and may offer them a product of equivalent quality and price or, failing this, a purchase voucher for the amount of the order that can be used for any future order.

In the event of disagreement from the buyer, the seller shall refund the sums paid within 30 days.

Apart from reimbursing the price of the unavailable product, the seller is not obliged to pay any cancellation compensation, unless the non-performance of the contract is personally attributable to them.

5 Prices

5-1 Selling price

The prices of the products to be sold by E.ZICOM are indicated in Euros on the site, all taxes included but excluding processing and shipping costs, and are valid as presented on the screen.

All orders are payable in Euros.

The E.ZICOM company reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time the orders are registered, subject to availability on this date.

. The products remain the property of E.ZICOM until full payment is received by E.ZICOM.

Any commercial offers are only applicable provided that they are expressly specified on the site at the date of the order and subject to compliance with the terms and conditions. They are not cumulative.

5-2 Product delivery and collection charges

The additional costs of transport, delivery or postage, of which the customer is made aware before the order and to which must be added any other costs borne by the seller, appear as additional costs to the price of the product(s) ordered in the pre-payment summary depending on the choice made by the customer.

For all orders under € 50.00 inc. VAT, the shipping costs to France (and Corsica) are:

  • CHRONOPOST delivery with Relay Point: Delivery the next day before 2pm in France to more than 5,000 Pickup Relays. The point Relay is to be chosen when you order: €9.99 inc. VAT
  • Predict home delivery by appointment: 24-72h home delivery in the time slot that suits you best (from the choices offered by DPD): €9.99 inc. VAT
  • Delivery by CHRONOPOST “CHRONO 13”: Next day delivery before 1pm from Monday to Saturday: €14.99 inc. VAT
  • For any order placed and of a value greater than or equal to € 50.00 including tax, shipping costs to France (and Corsica) are free with DPD PREDICT. Other transport options are payable in accordance with the tariffs indicated above.

For all orders placed to European and other countries, the shipping costs are managed by our Carrier, DPD. A typical example is given before any order is placed.

The customer should always check their package on arrival. They are strongly advised to make any Reservations they have upon receipt of the package with the Carrier.

Deliveries cannot be made to a P.O. Box, for C.O.D. or to a Post Office.

For reasons of availability, an order may be delivered to the customer in several instalments. The customer however pays for only one delivery. If the customer wants delivery to two different locations, they should place two orders, with the related delivery costs.

In the case of a technical product, the customer will take particular care to check the correct operation of the delivered appliance and read the user manual supplied to them. In case of apparent defects, the buyer has the right to return the goods under the conditions provided for in this document.

5-3 Price changes

The seller reserves the right to modify its prices at any time, in particular in the event of an increase in costs, it being understood that, in the event of a price increase after the order, only the price established on the day of the order will be applicable to the customer.

In the event of a price increase due to the application of the price in force on the day of delivery, the buyer has the right to cancel the order.

6 Payment of the price

The price invoiced to the customer is the price indicated on the order confirmation sent by E.ZICOM.
The price of the products is payable in Euros, in cash, on the day the order is effective.

6-1 Methods of payment

Purchases can be paid for by credit card through the MERCANET, PayPal or STRIPE secure online payment systems.

Any order confirmed by the customer will only be considered effective when the related bank payment centres have given their assent. In case of refusal of the said centres, the order will be automatically cancelled. Furthermore, E.ZICOM reserves the right to refuse any order from a customer with whom there is a dispute.

The BNP bank allows you to pay online via its bank server in a secure environment.
The customer’s credit card number is therefore passed to the bank’s servers. Customer payment is made directly with a bank in a totally secure and encrypted environment, without passing through the shop’s server, a guarantee that is of paramount important as the numbers are known only by E.ZICOM’s banking partner (BNP – MERCANET).

6-2 Retention of title clause

The seller remains the owner of the products sold until the price is paid in full and the buyer undertakes to take all precautions necessary for the proper conservation of the products until ownership is transferred to them.

7 Delivery

7-1 Definition

Delivery means the transfer of physical possession or control of the goods to the consumer.

7-2 Delivery time

The products shall be delivered on the date or within the period specified by E.ZICOM at the time of ordering.

In the absence of any indication as to the date of delivery or performance of services, the seller undertakes in any event to deliver the products or provide the services within 7 working days of the order.

7-3 Delivery delay

If the product ordered is not delivered or the service is not provided on the date or on expiry of the period mentioned when the order is made and validated by the payment, the consumer may, after having unsuccessfully requested that the seller fulfil its obligation to deliver within a reasonable additional period, cancel the contract by registered letter with acknowledgement of receipt or in writing via other durable media.

7-4 Place of delivery

The products are delivered to the address indicated by the customer.

7-5 Terms of delivery

Delivery is made by the direct handing over of the product to the buyer or, failing this, by the seller sending a notice of availability to the buyer.

The buyer must collect the product ordered within a 15-day period from the notice of availability.

If the buyer fails to collect within the period indicated, the seller may, after a formal notice to the buyer has been ineffective, proceed with collection and cancel the order as of right.

When the product is delivered by a carrier to the address indicated on the order form, it is up to the buyer to check the condition of the product delivered in the presence of the delivery person and, in the event of damage or missing items, express reservations on the delivery note or on the transport receipt, and possibly to refuse the product and notify the seller.

7-6 Delivery and transfer of risk

The risk of loss of or damage to the goods shall pass to the customer at the moment the customer or a third party designated by the customer and other than the carrier designated by E.ZICOM takes physical possession of the goods.

7-7 Spare parts

E.ZICOM guarantees to the consumer the storage and availability of spare parts for the goods sold for a minimum period of 3 years following the purchase of the product.

Articles L. 111-4 and D. 111-4 of the Consumer Code :

“Via the order form, the general terms and conditions of sale or any other durable medium, at the time the goods are purchased the seller must confirm to the consumer the information already supplied as pre-contractual information and which has been delivered to them by the manufacturer or importer of portable goods about the period during which, or the date until, the spare parts essential for the use of an item are available.”

8 Compliance

The Seller undertakes to supply goods in accordance with the applicable legal and contractual requirements.

9 Legal guarantee of conformity

9-1 Consumer information
Article L. 111-1(4) of the Consumer Code:

 

“Before the consumer is bound by a contract for the sale of goods or the provision of services, the trader shall provide the consumer with the following information in a legible and comprehensible manner:

 

Information on the existence and implementation methods of guarantees and other contractual conditions. The list and the precise content of this information are determined by decree in the Council of State”.

Article R. 111-1, c) of the Consumer Code :

 

“For the purposes of the fourth paragraph of Article L. 111-1, the trader shall provide the consumer with the following information:

 

c) If applicable, the existence and the terms of exercise of the legal guarantee of conformity mentioned in Articles L. 217-4 to L. 217-14 of the present code and that of the defects of the thing sold under the conditions provided for in Articles 1641 to 1648 and 2232 of the Civil Code as well as, where applicable, the commercial guarantee and after-sales service within the meaning of Articles L. 217-15 and L. 217-17 of the present code respectively”.

Article L. 211-2 of the Consumer Code:

 

“The general terms and conditions of sale applicable to consumer contracts shall mention:

 

According to the terms and conditions set by order of the Minister for the economy, the existence, the conditions of implementation and the content of the legal guarantee of conformity and the guarantee relating to defects of the sold item, due by the seller;

Where applicable, the existence of a commercial warranty and after sales service”.

Independently of any commercial guarantee that may be granted, the seller is liable for defects in conformity of the goods covered by the contract under the conditions of Article L. 217-4 and following of the Consumer Code and for hidden defects in the goods sold under the conditions provided for in Articles 1641 and following of the Civil Code.

In accordance with the law, E.ZICOM assumes two guarantees: of conformity and relating to hidden defects of the products. E.ZICOM shall refund the buyer or exchange products that are apparently defective or do not correspond to the order placed.

E.ZICOM products are covered by the legal warranty of 24 months.

All E.ZICOM consumablesare covered by a 1 year warranty. Batteries, having a limited cycle time, are considered a consumable.

However, the following are excluded from the guarantee: damage resulting from the non-respect of the instructions for use of the products, normal wear and tear of the products, their poor maintenance, accidental damage or damage resulting from abnormal use of the products, an error on the part of the customer, of their customer or the users of the equipment or a failure on their part to carry out elementary operations of use; damage resulting from the use or the installation of products other than those recommended by the manufacturer on the equipment; damage resulting from a cause external to the equipment or the installation or accessories (in particular, knocks, shocks, breakage, clearing rubble, oxidation, falls, fires, scratches, etc.); damage corresponding to normal progressive wear and tear of the equipment or its accessories involving their replacement; damage caused during the warranty period by or for which third parties are responsible when not approved by E.ZICOM or by the manufacturer.

The guarantees do not cover:

– Replacement of consumables (batteries, filters, brushes, virtual wall, power supply, charging station, perimeter cable, etc…)

– Abnormal or improper use of the products. The Customer is therefore invited to carefully consult the user manual supplied with the products as to proper usage,

– Breakdowns related to accessories (power cables, etc…),

– Defects and their consequences due to the intervention of a repairer not approved by E.ZICOM,

  • Defects and their consequences related to a usage non-conformant with the use for which the product is intended (professional, collective use, etc…),
  • Defects and their consequences related to any external cause.

E.ZICOM offers you a free service for the return of your product:

This includes:

* Shipping costs both directions

* Processing fee

* Processing within 21 working days maximum (within 5 days on average)

For any after-sales return request, customers from French overseas departments and territories will have their shipping costs, through the Colissimo Service (only), refunded by E.ZICOM.
In the event of a breakdown not covered by the guarantee, or sending an after-sales service file with missing administrative documents, a quote for €99.00 including VAT will be sent to the customer. If this is refused, the appliance will be returned after receipt of a copy of the signed quotation being re fused and a payment of € 32.00 including VAT for administration, storage and product return costs.

The seller is reminded that: :

  • the customer has a period of two years from the delivery of the goods to take action with the seller,
  • the customer can choose between replacing or repairing the goods,
  • the customer shall be exempt from furnishing proof of the existence of the lack of conformity of the goods during,
  • the customer can also assert the guarantee against hidden defects of the goods sold within the meaning of Article 1640 of the Civil Code, and in this case, can choose between cancellation of the sale or a reduction of the sale price.
9-2 Implementation of the guarantee of conformity
Article L. 217-4 of the Consumer Code:

 

“The seller is obliged to deliver a good in conformity with the contract and is responsible for the defects of conformity existing at the time of the delivery.

 

He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.

 

Article L. 211-5 of the Consumer Code:

 

“The property conforms to the contract:

 

whether it is fit for the purpose ordinarily expected of similar property and, if so

if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;

if it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;

Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and that the latter has accepted.

Article L. 217-12 of the Consumer Code:

 

“The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good “.

If you wish to make use of the legal guarantee of non-conformity, you must contact the company whose brand name and contact details are pre-printed on the front.

When he acts in legal guarantee of conformity, the consumer :

 

has a period of two years from the delivery of the property to act;

may choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;

is exempt from proving the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period shall be extended to 24 months from 18 March 2016, except for second-hand goods.

 

10 Warranty of hidden defects

Article 1641 of the Civil Code:

“The seller is bound by the warranty for latent defects in the thing sold which render it unfit for the purpose for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would have given only a lesser price for it, if he had known of them.

 

Article 1648 of the Civil Code:

 

“The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.

In this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

11 Commercial warranty

11-1 Consumer information

Independently of the commercial guarantee, the seller remains bound by the legal guarantee of conformity mentioned in articles L. 217-4 to L. 217-12 of the present code and that relating to the defects of the thing sold, under the conditions provided for in articles 1641 to 1648 and 2232 of the civil code .

11-2 Definition of the commercial guarantee

E.ZICOM offers its customers a 1-year commercial warranty that starts the day after the last day of the 2-year legal warranty. In order to benefit from this 1 year commercial warranty extension, you must register your product on the website www.eziclean.com in the “PRODUCT REGISTRATION” section and accept the terms of the extended warranty contract.

Article L. 217-15 of the Consumer Code:

“The commercial guarantee is any contractual commitment of a professional towards the consumer for the reimbursement of the purchase price, the replacement or the repair of the good, in addition to his legal obligations to guarantee the conformity of the good. “

11-3 Guarantee contract
Article L. 217-15 of the Consumer Code:

“The commercial guarantee is the subject of a written contract, a copy of which is given to the buyer.

 

The contract specifies the content of the guarantee, the terms and conditions of its implementation, its price, its duration, its territorial scope as well as the name and address of the guarantor and reproduces article L. 211-16. ”

 

11-4 Purpose and conditions of the guarantee

The seller undertakes to repair or replace under certain conditions the product sold if a defect appears within 1 year after the end of the legal warranty period.

11-5 Product downtime due to repair

In accordance with Article L. 217-16 of the French Consumer Code, any period of immobilization of at least seven days due to the repair of the product covered by the warranty is added to the duration of the warranty initially granted.

12- Breakdown at unpacking

This procedure applies to a breakdown that occurs and is reported to E.ZICOM or its reseller partner within 10 days of the product’s invoice date and/or receipt.

In order to meet customer requirements, E.ZICOM will ship a new replacement product subject to compliance with the conditions set forth in the “Acceptance Form.
